Howard Stern backers have long sought publicity for the host by interrupting everything from live television news shoots to golf tournaments by shouting various slogans and phrases from the show.

Now, a judge has ruled that doing so is legal.

Joey Boots -- a regular Stern called and a member of the shows Whack Pack -- was ticketed by police for jumping into a live shot during a WABC New York's 4 p.m. newscast.

The Stern fan yelled "Baba Booey! Howard Stern's penis!" in honor of both Stern and his producer Gary Dell'Abate. At the time WABC wanted him arrested

Since being ticketed Boots maintained that what he did was not illegal.

A New York judge agreed with Boots by dismissing the case.
